
History of the Department
Department of Constitutional and Civil Law of the L.N. Gumilyov Eurasian National University operates on the basis of two united departments: the Department of theory and history of state and law, constitutional law and the Department of civil, labor and environmental law.
The history of the Department of Constitutional and Civil Law dates back to 1998. The first head of the Department of state and legal disciplines was Doctor of Law, Professor Nurmagambetov A.M. (1999–2000). After his appointment to the public service, Candidate of Law, Associate Professor Uakpaev M.S. was appointed head of the Department. (2000–2001).
The first head of the Department of Theory and History of State and Law, which was established in 1999, was Doctor of Law, Prof. Agdarbekov T.A., subsequently the department was headed by Doctor of Law, Prof. Busurmanov Zh.D., Doctor of Law, Prof. Bashimov M.S., Candidate of Law, Associate Professor Nurpeisov E.K., Doctor of Law, Prof. Amandykova S.K.,, Candidate of Law, Associate professor Saktaganova I.S. and etc.
In 2003, two departments were formed: civil and labor law and the department of agrarian and environmental law. In 2001–2007, the department of civil and labor law was headed by Nurmagambetov A.M., Bukharbaeva S.A., Serikbekova S.B. and etc.
The Department of Agrarian and Environmental Law was headed by Doctor of Law, Prof. Abdraimov B.Zh. (2003–2006). In 2006, Doctor of Law, Prof. was appointed head of the department. Kosanov Zh.Kh. In 2007, the departments were merged into one - the Department of Jurisprudence under the leadership of Kosanov Zh.Kh. In 2008, the state certification commission of the Ministry of Education and Science of the Republic of Kazakhstan recommended disbanding the department of jurisprudence and creating independent departments, including the department of civil law. Doctor of Law, Professor Khadzhiev A.Kh. was invited to head the department of civil law disciplines. After tragic death of A.Kh. Khadzhiev department was again headed by Doctor of Law, Prof. J.H. Kosanov. In 2010 the department of civil and environmental law was headed by Doctor of Law, Associate professor Mukasheva A.A.
The demand for civil law disciplines, the prestige of civil law specialization among students, the rapid growth of civil law science, processes of denationalization, tasks of increasing competitiveness, strategic plans of the state, the development of private law relations, including those complicated by a foreign element, influence frequent changes in the organizational structure, appointment and election of leadership, names of the department of civil law cycle.
In 2012, Doctor of Law, Prof. Shiktybaev T.T. became the head of the Department of Civil Procedure and Labor Law. In 2014–2016, the department acquired a new name: civil law disciplines, the duties of the head of the department were performed by Doctor of Law, Professor Nurgalieva E.N., Candidate of Law, associate professor Zharkenova S.B., Candidate of Law, associate professor Serikbekova S.B., etc.
In 2016, the departments of civil law disciplines and environmental and business law merged, resulting in the formation of the department of civil and environmental law, headed by Doctor of Law, Professor A.A. Mukasheva. (2016–2017, 2018). Later, the duties of the head of the department were performed by Candidate of Law, associate professors Kusainov A.K. (2017), Toleubekov A.T. (2018).
In 2019, the head of the department becomes Doctor of Law, Professor Nurmagambetov A.M., holder of the Order “Kurmet”, the honorary title “Kazakhstannyn enbek sinirgen kairatkeri”.
By the decision of the Academic Council of the L.N. Gumilyov Eurasian National University dated February 25, 2019 (protocol No. 10), the Department was renamed the Department of civil, labor and environmental law. The Department of Civil, Labor and Environmental Law operates on the basis of two departments, united by the decision of the Academic Council of L.N. Gumilyov Eurasian National University No. 11 dated May 25, 2016, departments: department of civil law disciplines and department of environmental and business law.
Since December 8, 2022, the Department of Constitutional and Civil Law has been headed by Doctor of Law, Professor Bekturganov Abdimanap Elikbaevich, holder of the Order “Kurmet”, “Parasat”, medals: “Kazakhstan Republicsynyn tauelsizdigine 10 years”, “Kazakhstan Constitution 10 years”, “Kazakhstan Parliament 10 years", an I. Altynsarin medal, a breastplate "Honorary Worker of Education of the Republic of Kazakhstan".
For many years, Doctor of Law, Professor Nurgalieva E.N., Doctor of Law, Professor Beibitov M.S., Doctor of Law, Associate Professor Mukasheva A.A., Doctor of Law, Professor Abdrasulov E.B., Candidate of Law, Associate Professor Zharkenova S.B., Candidate of Law Zhussipova B.A., Candidate of Law, Associate Professor Saktaganova I.S., Candidate of Law, Associate Professor Makulbekov B.D., Candidate of Law Ormanova Sh.Sh., Doctor of Law, Associate Professor Ibragimov Zh.I., PhD Mugauova A.I., Master of Law Amirova A.M., since 2023 – PhD Kasymzhanova A.A., Master of Law Iskakova A.A. have been fruitfully working in the Department of constitutional and civil law.
The winners of the “Best University Teacher” grant were E.B. Abrasulov. (2007), Nurgalieva E.N. (2011), Saktaganova I.S. (2017), Ibragimov Zh.I. (2017), Mukasheva A.A. (2009, 2020).
The degree of the Department as of the beginning of the 2023-2024 academic year is 86%.
The Department has implemented a number of scientific projects - grant fundamental research, including within the framework of the state social order: (Head - Nurgalieva E.N.):
- Harmonization and unification of agricultural, land and environmental legislation of the participating countries of the Eurasian Economic Community and the CIS in the light of modern integration processes (2009 – 2011).
- Creation of a single legal space of the countries of the Customs Union in the field of social, labor and environmental relations (2012 – 2014).
- Organization of a comprehensive analysis and study of international experience in legislative support and the activities of government bodies in the field of human rights protection.
- Organization of a set of activities to study the issues of forming an effective model of social and labor relations.
- Increasing the level of interaction between NGOs and government bodies on issues of protecting the rights of citizens and others.
In 2012-2014 under the guidance of professor Nurgalieva E.N. a scientific project for fundamental research was developed on the topic: “Creation of a single legal space of the countries of the Customs Union in the field of social, labor and environmental relations”, prominent legal scholars from the department of civil law disciplines were involved in it, articles were published with the main results of the project, which had a positive resonance .
From 2016 to 2019, under the guidance of Doctor of Law, Professor Nurgalieva E.N. grants under the project “Increasing the level of interaction between NGOs and government bodies on the protection of human rights” with the support of the NJSC “Center for Support of Civil Initiatives” and the Ministry of Information and Social Development of the Republic of Kazakhstan were implemented. Doctor of Law, Associate professor Mukasheva A.A., Candidate of Law, associate professor Saktaganova I.S., Candidate of Law Ormanova Sh.Sh.took part in the project. As part of the grant implementation, seminars were held in almost all regions of the Republic of Kazakhstan, manuals and articles were published.
In 2020-2022, as part of the implementation of scientific, scientific and technical projects under grant funding from the Ministry of Education and Science of the Republic of Kazakhstan, a study was conducted on the topic: “Development of a legal mechanism for regulating the labor of medical and pharmaceutical workers” with the participation of Doctor of Law, Professor Nurgalieva E.N., Candidate of Law, associate professor Zharkenova S.B., PhD Galiakbarova G.G. and etc.
In 2024, an implementation of scientific project under the leadership of Doctor of Law, Associate professor Mukasheva A.A. with the participation of Candidate of Law Zhussipova B.A. “Problems of regulation of the legal regime of animals” began.
The department employs are well-known legal scholars of Kazakhstan, combining teaching with social and practical work, for example:
- Head of the Department, Doctor of Law, Professor A.E. Bekturganov has been a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan since 2016, headed Taraz and Zhetysu State Universities, held other leading positions.
- Doctor of Law, Professor. E.N. Nurgalieva was the head of the Legal Expertise Department of the Senate of the Parliament of the Republic of Kazakhstan, from 2003 to 2016 she was a member of the Human Rights Commission under the President of the Republic of Kazakhstan, a scientific consultant to the Supreme Court of the Republic of Kazakhstan, the Ombudsman of the Republic of Kazakhstan,
- Doctor of Law, professor E.B. Abdrasulov in 2008-2011, he was head of the Judicial System Research Department, the Department of Strategic Research and Analysis of the Supreme Court of the Republic of Kazakhstan, in 2012-2015 he was an adviser to a judge of the EAEU Court.
- Candidate of Law, Associate Professor Makulbekov B.D. was chairman of the regional courts of East Kazakhstan region, Kostanay region, judge of the Supreme Court of the Republic of Kazakhstan.
- Candidate of Law, Associate Professor Zharkenova S.B. since 10/28/2019 By Decree of the President of the Republic of Kazakhstan No. 195, was appointed a member of the Human Rights Commission under the President of the Republic of Kazakhstan. Since 2016 she has been a member of the Expert Council of this Commission, since 2012 she has been a national expert of the NAAR.
All members of the Department have practical work experience, which they apply in the educational process. The professional work experience and achievements of each of the members of the Department of Constitutional and Civil Law is displayed in the personal summaries of the teaching staff.
The department carries out the bulk of pedagogical and research activities in the field of theory of state and law, constitutional, civil, land, financial and administrative law.
The Department is the main developer of educational programs 6B04201, 7M04201, 8D04201 – "Jurisprudence". From 1999 to June 2024, the Department provided training in the educational programs "Jurisprudence", "Customs", "Fundamentals of Law and Economics", "Civil Law and Civil Procedure" and "Jurisprudence", since 2024, training has been conducted only in the field of Law.
New elective courses "Legal foundations of business modernization", "Legal regulation of entrepreneurial activity", "Legal foundations of competition", "Consumer protection", etc. were developed and introduced into the educational process on the initiative of teaching staff, students and stakeholders.
The Department of Constitutional and Civil Law has established and operates leading scientific schools: in the field of labor law – the school of Doctor of Law, Prof. Nurgalieva E.N., in the field of natural resource, agrarian and environmental law – the School of Doctor of Law, Professor Bekturganova A.E. and Doctor of Law , associate professor Mukasheva A.A.
At the initiative of the Department, events are held with the participation of foreign professors, such as summer (spring) school, online conferences, webinars. Various meetings, round tables and other career guidance events are held with the participation of employers, representatives of government agencies and stakeholders, allowing them to participate in the development and improvement of educational programs.
As part of the University's mobility program, the department widely practices inviting foreign specialists. Along with reading special courses, foreign colleagues conduct scientific and theoretical seminars on topical issues of theory and history of state and law, constitutional law for undergraduates, doctoral students and teaching staff of the department and faculty. So, from April 20 to May 3, 2023, in an offline format, the lecturer of the Department of "Intellectual Property Rights" of the Tashkent State Law University N.A. Turekulova conducted 12 hours of lectures and seminars in the disciplines of "Civil Law" and "Law of Obligations" for students of OP "6B04201-Jurisprudence", OP "6B04202-Civil law and civil procedure" (Order No. 672-P dated 01/21/2023).
В 2021-2023 годах кафедрой КиГП осуществлялось сотрудничество с профессором университета Феррара (г. Феррара, Италия), доктором права Марко Грегги (приказ №1601-п от 12.10.2021 г.). В 2022-2023 уч. году проф. Марко Грегги был штатным преподавателем кафедры и преподавал дисциплины: «Антикоррупционная политика» (обучающимся 2 курса «Международные отношения», «Политология» бакалавриата), «Методология правового анализа» (магистрантам 1 курса специальности «Юриспруденция») на английском языке (приказ №2501-п от 29.12.2022 г.).
В рамках программы академической мобильности на кафедре обучаются студенты из России, Узбекистана, Таджикистана, Кыргызстана и других стран.
In 2021-2023, the Department of constitutional and civil law collaborated with Professor of the University of Ferrara (Ferrara, Italy), Doctor of Law Marco Greggi (Order No. 1601-p dated 12.10.2021). In 2022-2023 academic year, Prof. Marco Greggi was a full-time lecturer at the department and taught the following disciplines: "Anti-corruption policy" (2nd year students of "International Relations", "Political Science" bachelor's degree), "Methodology of legal analysis" (1st year undergraduates of the specialty "Jurisprudence") in English (Order No. 2501-p 12/29/2022).
As part of the academic mobility program, students from Russia, Uzbekistan, Tajikistan, Kyrgyzstan and other countries study at the department.
The department has a student scientific circle "Kukyk uni", at whose meetings students study the problems of modern constitutional, civil, labor, environmental and other branches of law, headed by PhD, senior lecturer Kassymzhanova A.A.
The teaching staff of the Department is actively engaged in research activities, publishes monographs, textbooks, and is published in special publications, including abroad (in journals with an impact factor). For example, only in 2023 the teaching staff of the Department published scientific and educational manuals: 1 textbook, 2 textbooks, 4 teaching aids, 2 monographs. Under the scientific guidance of the faculty of the department, students actively participate in various events both at the regional, national and international levels.
The results of the research work of the Department are introduced into the educational process through elective master's and doctoral courses. The results of research are reported at round tables, conferences and scientific seminars, as well as published in the Bulletin of the ENU (Law Series), publications of the near and far abroad, including in journals belonging to Thomson Reuters and Scopus.
Today, the Department of Constitutional and Civil Law faces new challenges, new horizons of development. The activity of a team of teachers, scientists, doctoral students, undergraduates and students is aimed at continuous improvement of the educational process, research activities, educational and methodological work, and support for a creative attitude to their work.
